Conservation panel approves 22-unit riverfront project

Pembroke conservation board closes contested hearing, clears 22-unit project near a brook. The Conservation Commission voted to approve, with conditions, a Whatbarn LLC application for 13 buildings and 22 units at 660 Washington Street, rejecting abutters' attorney Donald Nagel's argument that an adjacent, resource-area-free portion of the same 18-acre parcel was a required alternative. Engineer Kevin Grady of Grady Consulting said the plan alters just 9.4 percent of the site's 258,000-square-foot riverfront area, under the 10 percent threshold allowed by state rules.

Nagel countered, "They presented three alternatives. None of them addressed areas outside of the riverfront area." The board also unanimously cleared a Certificate of Compliance for 99 Old Washington Street tied to a 1984 order of conditions, tabled a trail-kiosks discussion, and entered executive session over pending litigation, Spath v. Pembroke Conservation Commission.
